The disagreement began when footballer Ben Chilwell raised his back garden and erected a retaining wall. He then failed to get permission for a major makeover of the five bed luxury pad. 

Chilwell needed the greenlight before he could renovate his home to include a swimming pool, gym and game rooms. 

Documents submitted during the planning application revealed plans to also build a fire pit and a basketball court - with work originally set to start in April. 

His neighbours objected to the plan claiming they would lose privacy and the local council, Elmbridge Borough Council, sided with the angry locals.

However, now the council has had a VAR-style retrospective look at the application and overturned the previous rejection. 

The planning officer for the council, in words reported by The Sun, said: Despite the change in levels in this part of the garden, it is considered that the works do not significantly alter the overall land levels of the application site.  

Moreover, the works are located in the rear garden and would not be visible from the street scene and are therefore acceptable. 

MailOnline has approached a representative for Chilwell for a comment. 

The news will likely be celebrated by Chilwell whose recent football career has been plagued by injuries.  

Chilwell suffered a hamstring injury last season which caused him to miss the Defender to miss a multiple games for Chelsea at the start of the season.

Chelsea Manager Enzo Maresca then struggled to fit the defender back into his tactical plan for the squad which caused him to miss out on more games.  

In another blow, the 27-year-old also missed out on a spot on the England squad for Euro 2024.

The new season appears to be off to a better start for Chilwell after, despite rumours he could be sold by Chelsea over the summer, he was included in Chelseas Premier League squad. 

Maresca plans to hold a meeting with the 27-year-old to discuss a solution so he does not spend the next four months in the footballing wilderness.

One of the options on the table is allowing him to rejoin the first team until January when they could look for a potential buyer all over again.

Maresca had previously said that those training separately would not be used under him, with Chilwell excluded from the Conference League squad submitted by Chelsea to UEFA last week.

That means he cannot be used in any of the clubs next six fixtures in the European competition.
