William Hubbard, 19, died after being impaled by a fence post when Oliver Barber, 20, lost control of his car in Shifnal, Shropshire, on May 27 last year.

Hubbard, who had been binge drinking that night, was found to be three times over the drink drive limit.

A court heard that Barber got behind the wheel of his BMW 1 Series despite having spent the evening drinking with friends. 

He offered to give three people a lift home, including William, but shortly after getting in the car he collided with a fence on the A464. 

William, who was a backseat passenger, was pronounced dead at the scene despite the efforts of paramedics.

Barber suffered serious facial injuries and was taken to hospital for treatment, where it was discovered he was three times over the legal drink drive limit.

He was charged with causing death by dangerous driving which he pleaded guilty to last month.

On Thursday Barber, of Shifnal, was jailed for eight years and banned from driving for 11 years at Shrewsbury Crown Court.

Sentencing, Judge John Butterfield KC said: You missed a turn most likely due to a combination of speed and inattention. Further down that road the crash occurred.

The crash caused injuries to Will that no one could have survived. The fatality was caused by your dangerous driving.

The court was told Barber had been out drinking in Shifnal with two friends, when they decided to go a late night bar which required one to go home to get changed.

Prosecutor Suzzane Francis said they headed to the friends house just after midnight when William flagged the car down and asked to travel with them following a row with his girlfriend.

She said the four travelled out of Shifnal down singing with Barber travelling substantially over the speed limit causing one of the passengers to tell him to chill out.

The two surviving passengers had said in statements that Barber had missed a left turn to his friends house and turned his head, distracting him from the road ahead.

Ms Francis said the BMW hit a bollard on the opposite carriageway before hitting another head on in the centre reservation, which caused the car to career into a hedgerow and then a fence.

The court heard the airbags had deployed and Barber and two of his passengers got out, but it became immediately apparent to them William had been killed.

A post mortem revealed one of the fence posts dislodged by the BMW had flown through the windscreen and impaled him.

Barber was breathalysed and found to be over the drink drive limit and a further blood sample taken showing he had 134mg of alcohol in 100ml of blood - the legal limit being 80mg.

Andrew Thompson, defending, said his client had shown genuine remorse admitted drinking as well as speeding, and said he would never forgive myself for what happened.

Speaking after the sentencing, Williams family said their lives have been ripped apart and no punishment for the driver would compensate for their loss.

His mother Emma said: Will was the most loveable, funny, wilful, caring soul with a natural ability to just understand everyone he met and see their point of view.

His loss has had such a damaging effect on every member of our large family, his girlfriend, his numerous friends and the whole community.

Will should still be here, and I should not be giving a victim statement, I want people to realise and take notice that road crime is serious a crime and the devastating consequences will be forever endured by me and so many others.

I will spend the rest of my days missing my beautiful son.

PC Helen OConnor, from West Mercia Polices Serious Collision Investigation Unit, said: Barbers poor driving and driving while intoxicated caused this crash, which sadly led to the death of his friend, William.

The message I want to get across is that this collision could have been avoided if Barber had not got behind the wheel that night knowing he had drank more than the legal limit.

The collision that night has not only had a devastating impact on the family and friends of William, but also Barbers who will now spend eight years in custody.

We welcome the sentence that has been handed to Barber today, and I hope it sends a clear message that driving under the influence can have catastrophic consequences, and it will not be tolerated and offenders will be brought to justice.
