Iconic Mexican restaurant is shamed for harsh reservation terms and conditions

This agreement includes a section that makes customers forfeit their right to have any legal claims filed against Casa Bonita - a lively Lakewood, Colorado, Mexican restaurant and entertainment venue - heard by a judge or jury in public court, according to 9NEWS.

In Section 14 of the terms of service, the agreement reads: YOU ARE GIVING UP THE RIGHT TO LITIGATE A DISPUTE IN COURT BEFORE A JUDGE OR JURY.

This likely means that if any claims are brought up against Casa Bonita, which was bought by South Park creators Matt Stone and Trey Parker in 2021, they will be handled by a private mediator hired by the restaurant.

 Legal expert Whitney Traylor told 9NEWS: The reality is you’re giving up a very important right and you don’t know it.

I would assume 95 percent of the people who sign have no idea that theyve given up their right to a jury trial. 

Companies like Disney have used arbitration clauses to try to prevent people from suing them in public court, Traylor said.

Jeffrey Piccolo filed a wrongful death lawsuit against Disney after his wife died of an allergic reaction at the theme park in 2023.

Disney tried to make a case that Piccolo could not sue because he signed up for a Disney+ free trial, which has a terms and conditions agreement including an arbitration clause.

The company did eventually agree to go to court. 

Traylor described the complicated language used in terms and conditions agreements as legalese.

In response to learning about Casa Bonitas terms of use, people shared their shock online.

An X user commented: Not a sign of confidence in their product.

Someone on Reddit jokingly speculated: Prob[ably] to stop people from suing when they drunkenly try to jump into the pool and miss or drown.

Another outraged Redditor wrote: Arbitration should NOT be the new norm with corporations and how they go about any/all legal issues that may arise with their patrons and even employees.

But not everyone is troubled by the Casa Bonita legal news, as diehard fans were quick to defend their beloved restaurant.

One X user wrote: Trying to turn us against Casa Bonita?? I’m done here. [Just kidding], going even harder now.

Ultimately, people were not focused on the terms and conditions. Instead, the main point of the discussion was the reservation-making process, which many found stressful and disappointing.

The 56,000-square-foot restaurant originally opened in 1974 and quickly became a hot spot for celebrations and family dinners. Stone and Parker bought Casa Bonita after its 2020 bankruptcy and spent over $40 million renovating it. 

The South Park creatives saved the restaurant because of fond memories they had from their childhoods. They even based an episode of the show on their experiences there. 

Casa Bonita is unlike normal restaurants with it waterfalls, caves and diving pools. 

Reservation slots for October and November opened to the public on Monday for the first time since the 2023 re-opening. 

The only way to dine at the festive restaurant before then was to join a 600,000-person waitlist and be chosen from a random lottery, according to Mens Journal

One mind-blown Reddit user posted: Having grown up in Denver in the 70s and 80s, it cracks me up that I have 17,000 people in line in front of me to get a reservation. 

I remember days when we would just walk right in and basically have the place to ourselves.

At one point, 50,000 founders - people who signed up for the email list before the restaurants opening - were waiting on the 9 am online que to get a reservation, according to FOX31

At 3 pm, 30,000 more people tried to get a spot. All the reservations were filled in about two hours.

Someone posted on X: Casa Bonita irritates me so bad. why is it reservation only and why do those reservations take months?

Another user said: It is easier to get tickets to the Super Bowl than it is reservations at Casa Bonita.

Casa Bonita did not immediately respond to DailyMail.coms request for comment.
